WindTre is the first phone company to officially set price inflation. TIM’s CEO has already announced, that’s likely to follow soon. Similar to what happened later with the 28-day bill, it’s possible someone else could make the jump and adjust.
what does that mean? that If inflation goes up, the subscription price goes up, tooAnd all this without resulting in a change in the contractual terms.
Pending an official statement from WindTre that we have requested, or in any case for clarification on the matter, the only thing that is certain is that the new clause added in the contractual terms of all new contracts signed in recent days by the telephone operator, contracts valid for both fixed and mobile.
A paragraph that needs to be analyzed line by line to understand what will happen:
CUSTOMER ACKNOWLEDGMENTS AND ACCEPT THAT, EFFECTING JANUARY 2024, IN THE EVENT OF A POSITIVE ANNUAL CHANGE IN THE NATIONAL FOI CPI DETECTED BY ISTAT IN OCTOBER OF THE PRIORY YEAR, WINDTRE HAVE THE RIGHT TO INCREASE THE MONTHLY PRICE FOR A PERSONAL Amount Equal OR EQUAL TO THE CHANGE OF THIS INDICATOR IN ANY EVENT 5 % at least if this difference is less than that percentage.
The amendment, applied during the first quarter of each year, does not constitute a contractual amendment pursuant to Art. 13 of these Contract Terms, therefore, do not give the Customer the right to withdraw from the Contract without costs. The amount of the monthly price for the service, after adjustment, can be rounded to the nearest euro cent.
WINDTRE reports this amendment annually on its website and with publication in a national newspaper in the preceding seven days.
First of all, it is understood that even if the contracts are signed now, there will be no increases until 2024. WindTre took a year to ensure that all contracts for 2023 and the end of this year were actually amended to fit a new system.
It’s also good to pay attention to writing. In the event of a positive annual change“: An increase occurs only and exclusively if inflation increases, even by a few tenths of a percentage point No reduction is expected at all.
There are two cases: either the price stays the same if inflation goes down, or the price goes up if inflation goes up. The reference value will be the variance detected by ISTAT in October of the previous year, and given that we are starting in 2024, the reference will be October of the next year.
How high will prices go up? At least 5%: If the increase in inflation is 2/3%, WindTre will still apply a 5% increase, while if the increase is greater, WindTre will apply the inflation rate, rounded to the nearest euro cent.
The Company also determines that this is a contractual rule which is acknowledged and accepted by the Client, therefore any increase will not be a contractual change and therefore withdrawals cannot be requested without costs.
At this point it will be necessary to pay close attention to both the new contracts of the other operators and any promotions/renewals: the danger is that greedy promotion is used to tacitly accept the new terms. It cannot be ruled out, as we have said, that others may follow the same path.
